When the City Center MGM, etc etc etc, holding company, investment company, etc. etc. unilaterally decided they would mar the entire design of the City Center by lopping off the top of the Harmon Tower, did they breach the purchase contracts with buyers who have money in escrow on condos at Vdarra and the Mandarin Oriental Hotel? It sure looks like it.
You might be able to get your deposit back. Considering the price of the condo at purchase time, and the price they might fetch if sold today, it's worth a try.
To our minds, they can't sell you one thing and deliver another. So sue them.
"What if they had shorted the Empire State Building by a couple of football fields?
Or gave the Great Pyramid a flattop? Or built the Eiffel Platform?"
