WE BELIEVE THE NINTH CIRCUIT COURT OF APPEALS WILL BE PERSUADED TO FOLLOW THE ELEVENTH CIRCUIT DECISION.  

The Ninth Circuit Court of Appeals covers the Western United States, including Nevada.
